Widowers urged to seek cash By Fergus Shiel

British widowers living in Australia are being encouraged to sue for backdated pension payments worth thousands of dollars each a year.

For years, in breach of European law, the British Government has not treated these men in the same way as women who have lost their spouses when it came to benefits arising out of national insurance contributions.

Britain changed the law last year to make widowers entitled to some, but not all, of the same non-means-tested state benefits previously only payable to widows.

British lawyer Graham Ross says the new benefits will not be backdated to the date of the wife's death unless widowers seek to enforce their entitlements legally.

He says there are lawyers in Britain prepared to take on Australian cases with expectations of success, as most other cases have been settled in full.

One widower took his case all the way to trial in the European Court of Human Rights and won.

"It would seem that the government only want to pay those who sue," he said.

Mr Ross said there would be many expatriates in Australia who had lost their wives and would be entitled to claim. "There would likely be many hundreds around Australia who are simply unaware that the UK national insurance they paid whilst living in the UK entitles them to claim."

People are continually asking me what they can do to help PAS families. Here are two things that can be done now.

1)  Inter-rater reliability studies. PAS needs studies that will assess objectively, with statistical analysis, whether PAS is truly a syndrome. I profess that the syndrome does exist, and does so in accordance with the strictest medical/psychiatric definition of the term.   Some critics claim that the syndrome does not exist, that it is merely a figment of my imagination.  Inter-rater reliability studies are the best way to come to a definitive conclusion regarding this controversy.  If any of you know of a graduate student looking for a research project, recommend such a study for the student's consideration. Those of you who supervise graduate students in university settings might consider such a study for a student.  I myself cannot conduct such a study because of potential bias.

2)  This is a big one: PAS needs a foundation, a foundation specifically devoted to the PAS and nothing else. PAS needs a foundation to do all the things that a foundation can do, things that individuals cannot do working independently. The ideal person to fund such a foundation would be someone who not only has the enormous amount of money necessary to fund it but who is also a victim of a spouse's PAS indoctrinations. Such a person will "have been there" and knows personally the grief and suffering PAS causes. Keep this in mind in the course of your travels.  Because PAS is so widespread--a problem of international scope--there must be some philanthropist, somewhere, who qualifies. Perhaps there are a few such individuals who would pool their resources.

The people in the PAS Network are doers.  They recognize that things don't just happen, that there must be people who make things happen. Accordingly, we must be aware of this important need and we must keep our eyes open for people who are potential candidates for funding a Parental Alienation Syndrome Foundation.

20 Nov 2001 Coram Family Child Contact Centre, central London : Tony Coe, of Equal Parenting Council, after hearing the views of Alan Slade, a social worker and Head of Service at this centre, at the Making Contact Work conference of this date, has said "I would strongly suggest that no parent should go within a mile of [this centre]". Apparently, Mr Slade is reported to have said that "contact is not a right ... it should only be permitted if it is beneficial to the child". Enough said.

Please look at our entry in the name them and shame them section for Mrs Justice Hale/Dame Brenda Hale/Brenda Hoggett who is a judge in the CoA. You will then appreciate why we believe she is a feminist. The European Convention on Human Rights article 6.1 requires tribunals to be impartial. We do not believe this woman can be impartial in matrimonial and family cases given her previous publications and attempts to introduce 'no-fault' divorce. We are interested in someone making a legal challenge under the Human Rights Act 1998 about her impartiality. So, if you are taking your case to the CoA, we would be interested in hearing from you by contacting our secretary via enquiry form.
